What the cellar book does, what is free, what becomes of a studio photo, and the legal notice.

Kav is a cellar book. It files your bottles, reads your labels and tells you when to drink them. It sells nothing, buys nothing, and gives you no investment advice.
1. Purpose
These terms govern the use of the Kav app on iPhone. By installing or using Kav, you accept them. If you do not want them, do not install the app.
2. What the service does
Kav keeps your cellar's inventory. You photograph a label, Kav tries to recognise the wine, creates a record, and files it in a cellar, a bay, a bin. It can then show a market price, critic scores, and an indicative drinking window.
What Kav is not. It is not a wine buying or selling service, not investment advice, not a certified valuation or appraisal, and not an accounting tool. The prices shown are indicative: they come from a third-party provider, apply to a standard bottle, and constitute neither an offer, nor a price guarantee, nor an insurance value. Drinking windows are markers, not prescriptions.
3. The account
Kav runs on your iPhone. An account becomes necessary to sync your cellar between devices, for studio photos, and for market data. You can create one with Sign in with Apple or with a code received by email.
The account is personal. You are responsible for access to your iPhone and your Apple ID. You can delete your account at any time from Settings: deletion is immediate and permanent, and cannot be undone.
4. What is free, what is paid
The free tier covers up to 30 bottles in the cellar, 30 label scans and 30 studio photos, those two allowances counting for the whole lifetime of the account and not per month. Cutting out your own photos, which happens on the device, stays free with no limit. Search, filing, food pairing, multiple cellars and statistics are open to everyone.
Kav Premium lifts the bottle cap and opens 100 scans and 50 studio photos a month, market prices, critic scores, peak alerts and import and export. It costs 8.99 € a month or 59.99 € a year.
The subscription is sold by Apple and renews automatically unless cancelled at least twenty-four hours before the end of the period. Payment is charged to your Apple account. Managing and cancelling happen in your Apple account settings, never in Kav: I have no access to your payment method. Refund requests are a matter for Apple.
If you stop Premium, everything you created stays yours: your bottles, your notes, your history. Only the caps come back.
5. Your photographs and the shared catalogue
This section is worth reading in full, because it is particular to Kav.
When you photograph a bottle and Kav produces a studio photo from it, bottle straightened, hand removed, clean background, that image may join a catalogue shared between all users, so the same bottle does not have to be produced a hundred times over. By using this feature, you grant me a free, non-exclusive, worldwide licence to use the resulting image for that sole purpose, for as long as the service operates.
Three safeguards govern that entry. The image must show the same bottle as your photo. It must match the record you filed it under. And it must be presentable: whole bottle, sharp label, undistorted text, clean background. An image that fails one of those checks still comes back to you, but does not join the catalogue.
Your original photo never joins the shared catalogue and is visible only to you. It is deleted when you delete your account. A studio photo already added to the catalogue, however, stays there: it has ceased to be attached to you and now serves others. If you want it taken down, write to me.
You warrant that you hold the rights to the photographs you send and that they infringe on nobody.
6. What Kav does not guarantee about wines
Kav is made for wines meant for keeping. A small grower's cuvée, a co-operative bottle or a very local label may exist in no database at all: the record then stays incomplete, with no price and no score. That is normal behaviour, not a fault. The principle the whole product rests on is that no wine data is invented: what is missing stays empty.
Label recognition can also get things wrong. Always check the proposed record before confirming it, and you can correct it.
7. Your undertakings
- To use Kav in accordance with the law.
- Not to attempt to bypass the caps, the subscription or the service's protections.
- Not to send unlawful content, or a photograph you hold no rights to.
- Not to bulk-extract the shared catalogue, or automate use of the service.
- To keep your Apple ID and your email access secure.
8. Availability and changes
Kav is provided as is. It works offline for everything filed on your iPhone. Recognition, market prices, scores and studio photos, on the other hand, need a connection and depend on third-party services. I guarantee neither continuous availability nor the absence of errors. Features may change, and some may disappear if a provider stops its service.
9. Liability
You remain the sole judge of your buying, keeping and drinking decisions. I cannot be held liable for a wrong identification, an inaccurate or out-of-date price, a poorly adjusted drinking window, or a decision taken on the strength of that information. Nothing here deprives a consumer of the mandatory guarantees of French law.
10. Intellectual property
The Kav name, the app, its interface and its code belong to me. Wine data comes from third-party providers and remains their property. LWIN data is published by Liv-ex under a CC BY 4.0 licence. The content you create, your bottles, your notes, your photographs, stays yours, with the sole exception of the licence on studio photos described above.
11. Ending your use
You can delete your account and uninstall Kav whenever you like, with no reason given. I may suspend an account in case of abusive use, subscription fraud, or harm to the service or its users.
12. Changes to these terms
These terms may change. The date at the top of the page marks the latest version, and any notable change is flagged inside the app.
13. Governing law and disputes
These terms are governed by French law. If something goes wrong, write to me first at contact@lezbroz.com: most things get settled that way. Failing that, you can use a consumer mediator free of charge, or the European online dispute resolution platform. The French courts have jurisdiction.
